JAKARTA, KOMPAS - The case files on the alleged premeditated murder of Brig. Nofriansyah Yosua Hutabarat or “Brig. J.” and obstruction of investigation into the death were declared complete on Wednesday (28/9/2022). Public prosecutors are working overtime to complete the indictment so that former internal affairs head of the National Police, Insp. Gen. Ferdy Sambo and the other suspects can soon go to trial.
Deputy general crimes Attorney General at the Attorney General’s Office (AGO), Fadil Zumhana, in Jakarta on Wednesday, said although the case files were initially returned to investigators with instructions to complete them, they were eventually completed and declared to have met the formal and material requirements.
There are five suspects for premeditated murder, namely Sambo, his wife Putri Candrawathi, Richard Eliezer, Ricky Rizal and Kuat Ma’ruf. Meanwhile, there are seven suspects for obstruction of justice, namely Ferdy, Baiquni Wibowo, Arif Rahman Arifin, Chuck Putranto, Hendra Kurniawan, Agus Nurpatria and Irfan Widyanto.
After the completion of the case files, continued Fadil, the next step is the delegation of the suspects and evidence. Fadil asked that this be done as soon as possible so that legal certainty and justice can be given to the victims and suspects.
Fadil said that prosecutors are currently preparing the indictment for the two cases. To ensure it can be completed quickly, he even asked the prosecutors to work on the weekends if necessary. Thirty prosecutors have been appointed to handle the premeditated murder case, while 43 prosecutors were appointed for the obstruction of investigation case.
Because Ferdy Sambo is a suspect of both crimes, the indictments need to be combined in order for the trial to proceed effectively.
According to Fadil, until now his party has yet to decide whether they will detain Putri Candrawathi. He emphasized that it was the prosecutor’s authority to consider subjective and objective reasons. What they have done, however, is coordinated with the immigration directorate general to prevent Putri from fleeing overseas.
Separately, the police’s public relations head Insp. Gen. Dedi Prasetyo claimed that the completion of the two case files reflected the police and AGO’s commitments to thoroughly investigate the cases.
Cooperation
The head of Sambo and Putri’s legal team, Arman Hanis, said that his team immediately studied the case to prepare for trial. Arman said both Sambo and Putri respect the legal process and said that they will be cooperative throughout.
Arman added that Sambo apologized to all parties related to the case. Sambo also stated that he was ready to take responsibility for what he did.
Meanwhile, former Corruption Eradication Commission (KPK) spokesman Febri Diansyah said that he became Putri’s attorney with objective considerations.
“The team will carry out legal assistance that is objective,” said Febri.
Meanwhile, Indonesia Police Watch chairman Sugeng Teguh Santoso appreciated the police and AGO’s efforts to complete the two case files. He deemed that this would eliminate the various speculations regarding Nofriansyah’s murder, including the fabrication of the case to relieve Sambo.
