JAKARTA, KOMPAS – The results of a polygraph test taken by Second Agent (Bharada) Richard Eliezer Pudihang Lumiu, Brig. Ricky Rizal and Kuat Ma’ruf show that they are telling the truth. National Police investigators has said that the test results from the three suspects of the premeditated murder of Nofriansyah Yosua Hutabarat, or Brig. J, was evidence of their honesty.
During the police’s reconstruction of the murder earlier, discrepencies were found between the statements of Eliezer and fellow suspect Insp. Gen. Ferdy Sambo as to who fired the fatal shot on 8 July that killed Yosua.
Sambo’s wife Putri Candrawathi, who has also been named as a suspect in the case, also gave differing statements when the case was first publicized on 11 July and when she was named as a suspect on 19 Aug. Initially, Putri claimed that she had been sexually assaulted by Yosua at Sambo’s official residence in Duren Tiga, South Jakarta, where Yosua was fatally shot. Police dismissed her statement when they discovered that it had been fabricated by Sambo.
After she had been named as a suspect, Putri then said that Yosua had sexually assaulted her at Sambo’s house in Magelang, Central Java. This allegedly occurred before Putri, Yosua, Eliezer, Ricky and Kuat returned to Jakarta on 8 July.
Director for general crimes Brig. Gen. Andi Rian Djajadi from the National Police’s Criminal Investigation Department (Bareskrim) said on Tuesday (6/9/2022) that the results of the polygraph tests taken by Eliezer, Ricky and Kuat on Monday (5/9) indicated that no deception had occurred.
“The preliminary results of the polygraph tests taken by RE [Eliezer], RR [Ricky] and KM [Kuat] indicated no deception, meaning that they [told the truth],” Andi said.
According to him, Putri and a witness, Susi, Putri’s domestic assistant, also took polygraph tests on Tuesday. Sambo will take a polygraph test on Thursday (8/9).
Andi explained that the results of the polygraph tests would be used as evidence to indicate the suspects and witnesses’ level of honesty.
Not viable evidence
Agustinus Pohan, a criminal law lecturer at Parahyangan Catholic University in Bandung, West Java, said the results of a polygraph test could not be used as evidence. The tests should be used only to strengthen an investigator’s confidence in the truthfulness of a statement.
“Investigators still need to find [material] evidence to substantiate [the statement]. By law, there must be two pieces of evidence,” he said.
Apart from being questioned as a suspect of premeditated murder, Sambo will also be questioned on Wednesday (7/9) as a suspect of obstructing justice. Earlier, the National Police’s Code of Ethics and Professional Conduct Commission (KKEP) dishonorably discharged Sambo, as the KKEP found that Sambo had planned Yosua’s murder and displayed unprofessional conduct in processing the crime scene.
According to National Police public relations head Gen. Dedi Prasetyo, the commission also conducted an ethics hearing for Comr. Agus Nur Patria on Tuesday.
Agus is one of six polic officers suspected of interfering with the investigation into Yosua’s murder. The five others are Brig. Gen. Hendra Kurniawan, Adj. Sr. Comr. Arif Rahman Arifin, Comr. Chuck Putranto and Adj. Comr. Irfan Widyanto. The KKEP has already held an ethics hearing for Chuck and Baiquni and handed down a dishonorable discharge for the two.
Dedi said the investigators were currently focused on fulfilling the instructions from prosecutor’s office to complete the case files for the five suspects involved in Yosua’s murder, namely Sambo, Putri, Eliezer, Ricky and Kuat. Investigators were also completing the case files for the seven police officers suspected of obstructing the investigation into Brig. J’s murder.
