Insp. Gen. Teddy Minahasa faces the death penalty over drug trafficking. The public prosecutor considered Teddy had betrayed the trust of the public and the state.

JAKARTA, KOMPAS — Prosecutors demanded the death sentence for disgraced police officer Insp. Gen. Teddy Minahasa over an alleged drug trafficking. The prosecutors said Teddy was proven to have no right and no authority to distribute 5 kilograms of methamphetamine from West Sumatra to Jakarta.
During the trial at the West Jakarta District Court on Thursday (30/3/2023), Wahyudi, who acted as public prosecutor, was the last to read out the charges against Teddy before the defendant's attorneys, Hotman Paris and his team, as well as a judicial panel chaired by Jon Sarman Saragih. The prosecutor's demand was based on information gathered from 29 witnesses and a number of pieces of evidence.
The prosecutor asked the judicial panel to try the defendant who was proven legally and convincingly guilty of committing a crime as stipulated in Article 114 Paragraph 2 of Law Number 35 of 2009 concerning Narcotics in Article 55, Paragraph 1, 1st of the Criminal Code (KUHP).
"[Prosecutors] demand a death sentence to defendant Teddy Minahasa Putra, with an order to remain in detention," said Wahyudi.
After the criminal charges were read out, Teddy, who was wearing a long-sleeved batik shirt and black trousers, sat up straight and leaned back in his chair.
The judicial panel then asked Teddy's attorneys whether they would immediately submit an appeal. However, the team of attorneys represented by Hotman Paris asked the judicial panel to give them two weeks to present their defense. “Based on the agreement at the last hearing two weeks ago, please give us the same right to present a defense in two weeks. At that time the panel of judges had promised," said Hotman.
The judicial panel agreed to submit the defense note two weeks after last Thursday's trial, but on the condition that the agenda for replicas and duplications should be expedited.
“The defense notes should be given on the trial date on Thursday 13 April. Two weeks from now it's the same as the public prosecutor. But there should be certainty, because we have to finish within the allotted time. Then in two or three days it can be continued with replicas and duplications," said Jon Sarman.
No Mitigating Factors
The prosecutor considered that the criminal charge was given because of eight points of aggravating factors, including the defendant used the proceeds from the methamphetamine-type narcotics for personal gains. The defendant is a member of the National Police (Polri) with the position of West Sumatra Regional Police chief who should be at the forefront in eradicating narcotics trafficking.

However, the defendant instead involved himself and his subordinates, among others, the former head of the Bukittinggi Police, Adj. Sr. Comr. Dody Prawiranegara, by taking advantage of his position. The defendant's actions are considered to have damaged public trust in the Polri institution and damaged Polri's good name. His actions are also considered to have betrayed the orders of the President of the Republic of Indonesia because he did not support the government's program to eradicate illicit drug trafficking.
"The defendant did not admit his actions. The defendant denied his actions and was complicated in giving his statement," said another member of the prosecutor's team. Then, the prosecutor stated that there were no mitigating factors for the defendant.
Perfect crime
The facts from the trial showed that Teddy ordered Dody in May 2022 via a chat messaging app, to set aside 10 kilograms of methamphetamine from the 41.4 kg of methamphetamine seized by the Bukittinggi Police in several narcotics cases. In order to avoid suspicions, Teddy asked his men to replace the stolen meth with alums, intended for member bonuses.
In his statement, Teddy said the message was only to test the honesty of his subordinates. Later, however, Teddy sent similar orders several times and met Dody directly to ask him to sell methamphetamine, but Dody delivered only 5 kg of the total. Teddy then gave Dody the telephone number of Linda Pujiastuti, also known as Anita Cepu, who was going to receive the methamphetamine.
Teddy and Linda had known each other since 2006, but there was no communication until 2019. In 2022, Linda contacted Teddy to ask him to continue her business selling antiques in Brunei Darussalam and asked for operating money.
After that, Teddy admitted that he wanted to frame Linda for selling methamphetamine in Riau. In his statement, Teddy said he had to frame Linda because she had lied to him about information related to narcotics smuggling, and wanted to prove that Linda had a network.
Teddy admitted that this effort was part of an undercover buy or covert purchase as an official activity to uncover and arrest the perpetrators of drug trafficking networks.
Teddy, said the prosecutor, played a role in determining Dody's sales method, by sending him to Linda in West Jakarta. Teddy also always communicated with Dody. In communicating with Dody and Linda, Teddy often disguised the word methamphetamine with sembako (groceries) and galon (gallon).
Teddy knew that Dody had managed to sell 1 kg of methamphetamine for Rp 300 million in September 2022. Teddy ordered Dody to withdraw the remaining 4 kg of methamphetamine because it did not match the commission sharing scheme with Linda. However, the order was not delivered. Teddy received Rp 300 million in cash, which Dody had exchanged for 27,300 Singapore dollars.
"From the description above, it is clear that there was an act together as a conscious participant [medepleger] and a physical role to carry out the will and plan by the defendant together with Dody and Linda in the form of a series of close and strong cooperation so that the desired action together to be perfect," said the prosecutor.
Previously, the public prosecutor demanded 20 years in prison and a fine of Rp 2 billion to Adj. Sr. Comr. Dody Prawiranegara. Meanwhile, Linda faces 18 years in prison and a fine of Rp 2 billion which could be replaced by 6 months in prison. Meanwhile, prosecutors also demanded 17 years in prison and a fine of Rp 2 billion, a subsidiary of 6 months in prison to another defendant, Comr. Kasranto (former head of Kalibaru Police in North Jakarta).
