SURABAYA, KOMPAS — The Nahdlatul Ulama Executive Board (PBNU) received the efforts made by the Non-Judicial Settlement Team of Human Rights Violations in the past with a note not to forcibly reopen old wounds. Nahdlatul Ulama assessed that compensation and assistance to those who fell victim were absolutely supported, whoever the victim.
This was revealed when the Non-Judicial Settlement Team of Past Human Rights Violations (PPHAM) had an audience with PBNU and NU ulema at the Miftachus Sunnah Islamic Boarding School, in Surabaya, East Java, on Tuesday (12/27/2022). The audience discussed the 1965-1966 events and conflicts between NU and the Indonesian Communist Party.
The activity was attended by the Coordinating Political, Legal and Security Affairs Minister Mahfud MD who is also the head of the PPHAM Team, PBNU Rais Aam (senior figure) KH Miftachul Akhyar, PBNU chairperson KH Yahya Cholil Staquf, chairperson of the PPHAM team Makarim Wibisono and team members, as well as a number of NU figures.
KH Anwar Iskandar, deputy Rais Aam of PBNU, disclosed there was no reason for PBNU not to accept the PPHAM team's efforts. However, the effort was not received absolutely. There were notes, among others, not to let there be diction that reopens old wounds.
He hoped that the PPHAM Team would produce neutral recommendations and not be biased by certain political interests. The existence of the PPHAM Team should guarantee the creation of a stronger national unity.

Rehabilitation of the victims
Yahya Cholil Staquf assessed that the efforts made by the PPHAM Team have minimal partial pretension and political insistence. The efforts to resolve the alleged cases of gross human-rights violations in the past is the government initiative.
From the point of view of NU, he considered, there was no worry related to the 1965 event. This event occurred far in the past. The majority of those involved have died. The desire of the PPHAM Team to rehabilitate and provide restitution for victims without questioning the conflict that has occurred needs to be appreciated.
"Compensation and assistance to those who fell victim are absolutely supported, whoever is the victim. PBNU and NU Kiais [ulemas] believe that the PPHAM Team can run agendas in which the direction is constructive related to the traumatic events," he said.
NU supported the law-enforcement cases against gross human-rights violations as far as possible.

These cases, based on the results of the Komnas HAM investigation, were the 1965-1966 events, the 1982-1984 mysterious shooting, Geudong's house in the era of the 1989-1998 Aceh Military Operations and Talangsari in 1989. There were also the Trisakti incident in 1998, Semanggi I and II Riots May 1998, Simpang KAA in 1999, Murder of Shaman (Dukun Santet) in Banyuwangi in 1999, Wasior in 2001, Wamena in 2003, Jambo Keupok Aceh in 2003 and Paniai in 2014.
"There are two ways for a solution [to be found]: court sessions and non-judicially. The non- judicial way is usually called the Truth and Reconciliation Commission, but its law was canceled by the Constitutional Court and has not been drafted again. Meanwhile, we have the task of social, mental and psychological rehabilitation and so on. That is the reason for the PPHAM Team to be formed," he said.
He emphasized that non-judicial settlement did not delete the judicial process. The PPHAM team will not close the cases of gross human-rights violations.
After the audience with PBNU, according to Mahfud, the PPHAM Team immediately completed recommendations to be submitted to the President. The deadline for submitting the recommendation will be at the beginning of 2023; the team must finish it no later than 31 December 2022.
