At around 10 a.m. on Monday (17/10/2022), Ferdy Sambo was brought from the waiting room for the defense to the Oemar Seno Adji courtroom at the South Jakarta District Court. Sambo looked well Just before sitting down, he removed the red prison vest he was wearing. Dressed in a brown batik shirt, trousers and black shoes, Sambo sat facing the panel of judges.
In his hand was the indictment in a red folder, which he read as a representative from the prosecutor’s office read out the same document. Holding a yellow Stabilo highlighter, Sambo was seen marking parts of the document during the reading. Once in a while, he was also seen making notes with a pen in a black notebook he had brought with him to the first hearing.
Sambo wore a black mask. He seemed calm during the trial. However, he was seen moving his legs left and right on a dozen occasions within a single minute, even though his face had a calm expression.
Sambo looked up and stared at the prosecutor for a few minutes.
When the prosecutor stated that Sambo’s actions were not acts of chivalry and wisdom in his position as a high-ranking National Police officer who had planned the fatal shooting of Nofriansyah and engineered a cover-up, Sambo looked up and stared at the prosecutor for a few minutes.
The prosecutor also mentioned that, as a high-ranking police officer, Sambo had committed a disgraceful act by spreading a fake story that had been designed. This fake story had also been concocted merely as self-defense and to place all blame on the deceased Nofriansyah. Sambo was seen rubbing the center of his forehead during this statement.
Sambo did not say much during the hearing. When presiding judge Wahyu Iman Santosa asked him whether he understood the indictment read out by the prosecutor, Sambo said he understood. He then handed the indictment to the legal team headed by Arman Hanis to continue the hearing. The legal team then read out the defense’s statement listing objections or exceptional circumstances, which stated that the prosecution had ruled out many facts, in particular that the incident at a house in Magelang, Central Java, had been the trigger for the fatal shooting of Nofriansyah.
After the Sambo's indictment hearing was over, it was the turn of Sambo's wife, Putri Candrawathi, to hear the indictment of charges against her. Just like her husband, Putri entered the courtroom wearing a red prison vest. She then took off the vest befor sitting in the defendant's chair. Putri attended the hearing in a white shirt, black pants and white sneakers.
When the prosecutor read out the indictment, Putri was seen reading through the documents she held in her hand. Just like her husband, she also marked some notes in the documents using a pen.
When presiding judge Wahyu Iman Santosa asked Putri if she understood the indictment that had been read out, Putri answered in a low voice that she did not.
"Sorry, Your Honor, I don't understand," she said.
Putri was accused of premeditated murder and violating Article 340 of the Criminal Code (KUHP), as well as charged with Article 338 on murder in the KUHP.
The prosecutor then asked the judicial panel for permission to briefly explain the indictment. According to the prosecutor, Putri was accused of premeditated murder and violating Article 340 of the Criminal Code (KUHP), as well as charged with Article 338 on murder in the KUHP.
“So there are several people who have been charged with premeditated murder. It's not just Ibu PC. This is clear from the chronology of events in the indictment, in which Ibu PC called Sambo, ordered a PCR test after arriving in Jakarta and other things that we read out in the indictment, Your Honor," said the prosecutor.
Despite the prosecutor’s explanation, Putri maintained that she still didn't understand.
Depression
When the legal team presented the defense’s exception outlining the chronology of the sexual harassment that allegedly occurred in Magelang, Putri had her head down, with her hair covering part of her face. Her hands were clenched atop of her copy of the indictment. Putri was also observed rubbing her left eye while the exception was read out. Her chest rose and fell as she sighed behind her mask-covered face.
Putri's lawyer, Febri Diansyah, asked the judicial panel to move his client from the detention center at the Attorney General's Office to the Mobile Brigade Headquarters in Kelapa Dua, Depok. The reason for the request was that Putri wanted to make it easier for her toddler child to visit.
Febri added that Putri’s spirit had been shaken after the sexual harassment she experienced in Magelang that had led to Nofriansyah’s murder. In fact, a psychiatric team had stated that Putri was exhibiting symptoms of depression and acute trauma. "A psychiatric analysis revealed that our client was depressed," he said.
The judges rejected the request to move Putri’s location of detention, and permitted family visits once every two weeks in accordance with the provisions of the Criminal Law Procedures Code. (DEA/NAD/Z05)
