National Police Chief General Listyo Sigit Prabowo gave a press statement on Tuesday (12/7/2022) at the National Police Headquarters, Jakarta. Listyo explained the case of a shootout at the official house of the Head of the Propam Police which caused the death of a member of the police force.

JAKARTA, KOMPAS — The day after naming Bhayangkara Dua (Second Patrolman) Richard Eliezer Pudihang Lumiu as a suspect in the fatal shooting of Brigadier Nopryansyah Yosua Hutabarat, a special team from the National Police examined 25 personnel. They are suspected of obstructing the investigation into the shooting that occurred at Insp. Gen. Ferdy Sambo's official residence. Three of the 25 personnel are high-ranking police officers.

National Police chief Gen. (Pol.) Listyo Sigit Prabowo also removed Ferdy Sambo from his position as head of the National Police's Profession and Security Division (Propam) after being decommissioned. In addition to Ferdy, 14 other high and mid-level police officers were removed. This series of events opens up the possibility that there are other actors outside of Eliezer.

During a press conference at the National Police headquarters in Jakarta on Thursday (4/8/2022) evening, Listyo Sigit Prabowo said that even though a number of steps had been taken in investigating the Nopryansyah shooting case and explaining it transparently, the public was still asking about the damaged monitoring cameras.

This is related to the alleged unprofessional handling of the crime scene (TKP) at Ferdy Sambo's official residence. As a result, there are obstacles, both in handling the crime scene and in the investigation.

To investigate these allegations, the National Police's special team examined 25 personnel consisting of three one-star high-ranking officers, five chief commissioners, three adjunct chief commissioners, two commissioners, seven first officers, as well as five non-commissioned officers and enlisted personnel. They come from the propam, regional police (polres), provincial police (polda) and the Criminal Investigation Department (Bareskrim) units.

"Against the 25 personnel, we will carry out an examination process related to violations of the code of ethics. If a criminal process is found, we will process the crime in question," Listyo said.

Can be perpetrators

The head of Bareskrim, Comr. Gen. Agus Andrianto, said that the status of the personnel who underwent the code of ethics examination process could be upgraded to become perpetrators, in accordance with Articles 55 and 56 of the Criminal Code (KUHP), which are alleged to be against Eliezer.

The special team of Bareskrim also received a letter from investigators to evaluate the handling of the police report that was transferred from the South Jakarta Police to the Jakarta Police. The team will examine whether the stages of the process carried out are in accordance with the provisions.

"This is to carry out the order of the National Police chief, namely to make this case clear so that anyone who participated or ordered it will be exposed," he said.

With regard to the examination of the 25 personnel, the National Police chief issued a special telegram to transfer 15 high- and mid-level officers. In the Telegram Letter No. 1628/VIII/Kep/2022 dated 4 August 2022, besides Ferdy Sambo who was removed from his position, Brig. Gen. (Pol) Hendra Kurniawan was also removed from his position as the head of the Internal Security Bureau of the Profession and Security Division (Propam) along with a number of other officials in the National Police's Propam division.

Adj. Sr. Comr. Ridwan Rheky Nellson Sublanit was also removed from the position of head of South Jakarta Police’s Criminal Investigation Unit and Adj. Comr. Rifaizal Samual from the position of head of Unit I of the South Jakarta Police Criminal Investigation Unit.

Since Thursday morning, investigators have been examining Ferdy Sambo. He was questioned for seven hours in the Bareskrim building. After being questioned, Ferdy said that he had conveyed what he knew, saw and witnessed at his official residence at the Duren Tiga Police Complex, Jakarta.

"Let's trust the special team together, which will explain clearly," said Ferdy.

Meanwhile, Eliezer's lawyer, Andreas Silitonga, questioned the procedure for naming his client as a suspect. Eliezer was still being questioned as a witness until Thursday (4/8) at 1:02 a.m. However, three hours earlier, a special police team had named him a suspect.

Separately, lecturer in criminal law at Trisakti University, Abdul Fickar Hadjar, said the inclusion of Articles 55 and 56 of the Criminal Code (KUHP) on Eliezer implies that it is not only one person being held responsible. There are other actors who have worked together with their respective roles. Those roles, for example, include being ordered, assisting and serving as a helper.

"It means that there are others who should be responsible besides Bharada E," he said. The police must find the other culprits, which will lead to the mastermind of the murderer.

Separately, deputy chairperson of the Witness and Victim Protection Agency (LPSK) Edwin Partogi confirmed that one way to find the other perpetrators in the Nopryansyah shooting case was to obtain information from Eliezer. However, to get that information, he reminded investigators to confirm Eliezer's condition.

"It is better to ensure that there is no torture, commotion or fights between prisoners, no sickness, no poisoning and no suicide in detention," said Edwin.

The LPSK can provide protection to Eliezer if he is willing to become a justice collaborator. Previously, Eliezer applied for protection from the LPSK, but the application has not yet been decided. The LPSK is still studying the results of the investigation and clarifying things that have been disclosed by Eliezer.
