The National Police chief listens to all public aspirations, and it is a commitment from the National Police leadership to maintain independence, transparency, and accountability.
JAKARTA, KOMPAS — The National Police have said that a special investigation team has found surveillance camera footage that could be used as evidence in uncovering the events surrounding the death of Brig. J, or Nofriansyah Yosua Hutabarat, at the residence of the now inactive Internal Affairs chief, Insp. Gen. Ferdy Sambo. During a previous investigation by the South Jakarta Police, the police said that the existing surveillance camera was damaged and could not be used as evidence.
To further the investigation into the fatal shootout between two police officers, National Police chief Gen. Listyo Sigit Prabowo on Wednesday (20/7/2022) suspended two additional police officers, South Jakarta Police chief Sr. Comr. Budhi Herdi Susianto and Internal Security Bureau (Karo Paminal) head Brig. Gen. Hendra Kurniawan of the National Police Internal Affairs Division.
Earlier, the National Police chief had temporarily suspended Ferdy from his position as head of the Internal Affairs Division (Propam).
The investigation has also been taken over by the National Police’s Criminal Investigation Department (Bareskrim) from the Jakarta Police. In fact, it was only on Tuesday (19/7) that the National Police’s Public Relations Division said that the previous investigation by the South Jakarta Police had been transferred to the Jakarta Police.
National Police public relations head Insp. Gen. Dedi Prasetyo said on Wednesday evening that the discovery of footage from the surveillance camera was expected to shed light on the incident. "The footage is being studied by a special team and will be revealed [to the public] after the team has completed its entire investigation," he said.
Previously, the National Police said that Nofriansyah had died in an alleged shootout with Bhayangkara Dua (Second Agent) E at Ferdy's official residence.
The suspension of the South Jakarta Police chief and the Internal Security Bureau head (Karo Paminal), according to Dedi, was intended to maintain the independence, transparency, and accountability of the special team formed by the National Police chief.
Of course, this must go through a process with guaranteed legality.
"The National Police chief listens to all public aspirations, and [it is] a commitment from the National Police leadership to maintain independence, transparency, and accountability, so the team must perform at its maximum [level]," said Dedi.
Bareskrim director Brig. Gen. Andi Rian Djajadi added that one of the things the investigators would do was to synchronize and calibrate the clocks of the footage, because there could be surveillance footage of the same location from three different cameras, but their clocks could be different.
"Of course, this must go through a process with guaranteed legality. So it is not based on what the investigators want, but on data or metadata from the CCTV [cameras],” Andi said.
Second autopsy
The Bareskrim also agreed to a request from the legal team of Nofriansyah’s family to conduct a second autopsy on Nofriansyah's body. The agreement was reached over the initial report alleging that the case was one of premeditated murder, which was filed at the National Police headquarters on Wednesday afternoon by the legal team of Nofriansyah’s family. The meeting was attended by representatives of Bareskrim and the National Police Commission (Kompolnas).
For the second autopsy, Andi said, the police would involve the National Police Center for Medicine and Health (Pusdokkes Polri) and external forensic professionals, including members of the Indonesian Forensic Doctors Association. He added that the autopsy would take place immediately because it was a race against the natural process of decomposition.
After the meeting on the initial police report, Kompolnas executive chairman Insp. Gen. (ret) Benny J. Mamoto said that in addition to requesting a second autopsy, the Nofriansyah family’s legal team had also complained about the police officers who had been sent to meet the family in Jambi. Benny said the National Police would look into the complaint by questioning the now-suspended Internal Security Bureau head.
Benny added that the investigation had been taken over by the Bareskrim after considering the many parties that were involved in the case. Besides that, the Bareskrim also had the resources and facilities to conduct a scientific investigation (SCI).
On the other hand, the Kompolnas made assurances that the special investigation team would explore various issues and irregularities that had been publicized. These included issues such as Ferdy’s whereabouts when the shootout occurred at his residence, surveillance footage, and a press conference on the death of Brig. J that took place three days after the incident had occurred.
"So, all the public’s questions are being explored one by one," explained Benny.
He added that the Kompolnas had visited Ferdy's residence and claimed to have received a picture connected to the incident.
Allegation of strangulation
Kamaruddin Simanjuntak and Johnson Pandjaitan, the lawyers of Nofriansyah's family, said one of the reasons they had requested a second autopsy was because of the injury that were found on the victim's neck. It was suspected that the injury was caused by a rope. They had revealed previously that a variety wounds and bruises were found on Nofriansyah's body.
The discovery of the wounds led them to suspect that he had been killed by more than one person, and that his killing was premeditated.
Meanwhile, a separate investigation team from the National Human Rights Commission (Komnas HAM) said that it was creating a chronology of the data it had received to shine a light on Nofriansyah’s death. Komnas HAM commissioner Choirul Anam said on Thursday (7/21) that the team would meet with a number of experts to discuss the injuries found on Nofriansyah’s body.
