JAKARTA, KOMPAS – Two former directors and another former senior executive of state-owned insurance company PT Asuransi Jiwasraya have been sentenced to life imprisonment for their involvement in the corruption case at the insurance company. The sentence handed down to the former finance director, Hary Prasetyo, was in line with the persecutors’ demands, while heavier-than-sought sentences were given to the former president director, Hendrisman Rahim, and the former head of the investment and finance division, Syahmirwan.
The sentences were read out by the head of the panel of judges, Susanti, during the verdict hearing for four defendants in Jakarta on Monday (12/10/2020).
However, by 11 p.m., the panel of judges had yet to issue its verdict on the fourth defendant and former director of PT Maxima Integra Tbk, Joko Hartono Tirto.
(The court) tried and declared the defendants legally and convincingly proven guilty of committing a criminal act of corruption that was carried out jointly as the primary indictment.
The four defendants were tried for their alleged involvement in the Asuransi Jiwasraya corruption case.
They all attended the verdict hearing, which was held virtually. The life imprisonment sentence for Hary was in accordance with the demand of the prosecutors, who had asked for a life sentence and a fine of Rp 1 billion or six more months in prison.
"[The court] tried and declared the defendants legally and convincingly proven guilty of committing a criminal act of corruption that was carried out jointly as the primary indictment," presiding judge Susanti said.
The life imprisonment sentence for Hendrisman was heavier than the 20 years and a fine of Rp. 1 billion or an additional six months in prison demanded by the prosecutors.
Likewise, the life imprisonment sentenced for Syahmirwan was heavier than the prosecutors’ demands of 18 years in prison and a fine of Rp. 1 billion or an additional six months in prison.
The verdict hearings for another two defendants, namely Benny Tjokrosaputro and Heru Hidayat, has been postponed because the two tested positive for Covid-19 and are currently being treated at the Adhyaksa General Hospital, Jakarta.
New suspects
Meanwhile, during the trial, the Attorney General\'s Office (AGO) investigators again named a new suspect in the PT Asuransi Jiwasraya corruption case.
The new suspect is Piter Rasiman, or PR, who stands accused of establishing a company affiliated with one of the defendants, Joko Hartono Tirto.
“PR established the company that was allegedly used to place the money originating from PT Asuransi Jiwasraya under a modus operandi as if the company ran mutual fund investments of gradually increasing value. In fact, the company was affiliated with the defendant Joko Hartono Tirto,” said Hari Setiyono, the head of the Legal Information Center at the AGO.
According to Hari, eight companies were allegedly used to manage PT Asuransi Jiwasraya’s investments.
Previously, the evidence of PR’s charges was considered insufficient. However, after the investigators found sufficient preliminary evidence, PR was named a suspect. PR is currently the president director of PT Himalaya Energi Perkasa Tbk.
PR, among other charges, was charged under Article 2 Paragraph 1 subsidiary Article 3 of Law No. 31 of 1999 concerning corruption eradication in conjunction with Law No 20 of 2001 concerning corruption eradication.
PR is currently detained at the Salemba detention center for the next 20 days. The AGO investigators have also arrested FH, who was officially named a suspect in the Jiwasraya corruption case in June this year. He was the head of the capital market supervisory department IIA at the Financial Services Authority (OJK) from February 2014 to February 2017.
